DealConverter is committed to providing its Services and customer support in a professional, safe and respectful environment.
The Customer acknowledges that DealConverter's employees, support personnel, technical teams, account managers, representatives, contractors and other personnel are entitled to communicate and work in an environment free from threats, harassment, intimidation, abuse, discrimination and unreasonable conduct.
The Customer is responsible for ensuring that its directors, employees, representatives, agents, contractors, users and any other person acting on behalf of or using the Customer's account comply with this section.
The Customer shall not engage in conduct that is abusive, threatening, harassing, intimidating, discriminatory, defamatory, offensive, fraudulent, unlawful or materially disruptive to DealConverter, its personnel, its operations or its Services.
2.1 Threats and intimidation The Customer shall not: - threaten DealConverter or any of its employees, representatives or contractors with physical harm; - threaten violence or unlawful action; - use intimidation to obtain a refund, service concession, account restoration or other benefit; - threaten employees with personal consequences unrelated to legitimate legal or contractual remedies; or - make threats intended to create fear or pressure an employee into taking an action outside normal company procedures.
2.2 Verbal or written abuse The Customer shall not engage in repeated or serious: - verbal abuse; - personal insults; - offensive language; - obscene or degrading language; - humiliation; - name-calling; - abusive emails or messages; - abusive telephone calls; or - other communications directed personally at DealConverter personnel rather than addressing the underlying service issue professionally.
2.3 Harassment The Customer shall not repeatedly contact, pursue, intimidate, pressure or harass an individual DealConverter employee or representative after being requested to use the appropriate support or communication channel.
This includes repeatedly contacting an employee through multiple personal or unofficial channels for the purpose of pressuring, intimidating or harassing that individual.
2.4 Discriminatory conduct The Customer shall not make discriminatory, derogatory or hateful statements directed at DealConverter personnel based on protected characteristics or otherwise engage in conduct prohibited by applicable law.
2.5 Personal attacks The Customer shall address service, billing, technical or contractual concerns through appropriate business communication.
Personal attacks against employees, including comments concerning their personal life, appearance, family, identity or other unrelated matters, may constitute a violation of this section where such conduct is abusive, harassing or materially disruptive.
2.6 Excessive or unreasonable communications DealConverter understands that customers may occasionally be dissatisfied, frustrated or require urgent assistance.
However, DealConverter may take action where a Customer engages in excessive or unreasonable communication that materially interferes with the Company's ability to provide support to the Customer or other customers.
Examples may include: - sending an excessive volume of substantially repetitive messages; - repeatedly opening support tickets concerning the same issue without providing new information; - repeatedly demanding immediate responses outside reasonable support procedures; - repeatedly contacting multiple employees regarding the same unresolved matter; - continuing abusive communications after being asked to communicate professionally; or - intentionally occupying support resources in a manner that materially affects normal operations.
Reasonable use of customer support, legitimate complaints, repeated follow-ups concerning an unresolved issue, or good-faith escalation of a genuine problem shall not by themselves constitute prohibited conduct.
Nothing in this section is intended to prevent a Customer from: - making a genuine complaint; - reporting a technical problem; - requesting a refund in accordance with the Refund Policy; - disputing an invoice; - requesting escalation; - exercising a contractual right; - exercising a statutory or legal right; - providing negative feedback in a lawful manner; or - seeking assistance from a competent authority, regulator, consumer forum or court.
A Customer will not be penalized merely because it disagrees with DealConverter, submits a legitimate complaint, requests escalation or expresses dissatisfaction in a professional manner.
The purpose of this section is to regulate the manner of conduct, and not to prevent legitimate complaints or legal rights.
Where the Customer has a complaint or technical issue, the Customer should provide sufficient information for DealConverter to investigate the matter.
This may include: - account information; - relevant transaction details; - screenshots; - recordings; - error messages; - relevant dates and times; - steps taken before the issue occurred; - relevant technical information; and - other information reasonably requested by the support team.
DealConverter may require the Customer to continue communication through designated support channels where doing so is reasonably necessary for proper documentation and resolution of the issue.
Except where immediate action is reasonably necessary, DealConverter may issue a warning to the Customer when it reasonably believes that the Customer has violated this section.
The warning may: 1. identify the nature of the conduct; 2. request that the Customer cease the prohibited behavior; 3. direct the Customer to use an appropriate communication channel; 4. identify any applicable support or escalation process; and 5. inform the Customer that continued violations may result in restriction, suspension or termination of the account.
Where appropriate, DealConverter may provide the Customer with a reasonable opportunity to correct the conduct.
DealConverter is not required to provide a warning where the conduct is sufficiently serious to justify immediate action.
Where a Customer repeatedly engages in abusive, harassing or materially disruptive conduct, DealConverter may reasonably restrict the manner or channel through which support is provided.
For example, DealConverter may: - require communication through a designated support email; - require communication through a ticketing system; - assign a designated point of contact; - limit duplicate or repetitive support tickets; - discontinue communication through unofficial channels; - require written communication instead of telephone communication; - consolidate multiple support requests into a single ticket; or - take other reasonable measures necessary to protect support operations.
Such measures are intended to preserve a professional support environment and shall not prevent the Customer from raising legitimate service, billing or legal issues through the Company's designated channels.
DealConverter may temporarily suspend or restrict access to all or part of the Services where the Customer's conduct reasonably presents: - a security risk; - a threat to employees or representatives; - a threat to other customers; - a risk of unlawful activity; - a risk of fraud or abuse; - a material disruption to Company operations; - a risk to the integrity of the Services; or - a serious violation of these Terms of Service.
Where reasonably practicable, DealConverter may notify the Customer of the reason for suspension.
DealConverter may restore access where the underlying issue has been satisfactorily addressed and restoration is reasonably appropriate.
DealConverter may immediately suspend or terminate the Customer's account or access to the Services, without a prior warning where reasonably necessary, if the Customer or anyone acting through the Customer's account: 1. threatens physical violence or harm; 2. makes credible threats against DealConverter personnel; 3. engages in serious harassment or intimidation; 4. engages in unlawful conduct; 5. attempts to defraud DealConverter; 6. engages in serious abuse of Company personnel; 7. attempts to compromise the security of DealConverter's systems; 8. attempts unauthorized access to Company systems or another customer's account; 9. intentionally distributes malware or harmful code; 10. engages in conduct that creates a serious security or operational risk; 11. repeatedly violates this section after receiving a warning; 12. materially interferes with DealConverter's operations; or 13. engages in any other conduct that reasonably requires immediate action to protect persons, systems, data or business operations.
Where a Customer's conduct is not sufficiently serious to justify immediate termination but nevertheless repeatedly interferes with DealConverter's ability to provide its Services or support, DealConverter may terminate the Customer's account after providing reasonable notice and an opportunity to correct the conduct, where reasonably practicable.
For purposes of this section, repeated unreasonable conduct may include a continuing pattern of: - abusive communications; - harassment; - intimidation; - excessive repetitive support requests; - deliberate misuse of support channels; - refusal to follow reasonable support procedures; - repeated personal attacks on employees; - repeated violation of communication boundaries; or - other materially disruptive behavior.
A single instance of ordinary frustration, disagreement or dissatisfaction shall not ordinarily constitute grounds for termination under this section.
The Customer is responsible for the conduct of persons using its DealConverter account or acting on its behalf, including: - employees; - agents; - contractors; - representatives; - administrators; - authorized users; and - other persons provided access to the account.
Where conduct by such a person violates this section, DealConverter may take action against the relevant user, account or Customer as reasonably appropriate.
The Customer shall take reasonable steps to prevent continued prohibited conduct by persons acting on its behalf.
DealConverter's customer support personnel are not required to continue a communication in circumstances where the Customer is: - threatening; - abusive; - harassing; - intimidating; - using discriminatory language; - making personal attacks; or - otherwise engaging in conduct that creates an unsafe or materially hostile working environment.
In such circumstances, DealConverter may end the communication and require the Customer to continue the matter through an appropriate alternative channel.
Ending an individual communication does not necessarily constitute termination of the Customer's account.
Where reasonably necessary, DealConverter may retain and review relevant records of communications, support tickets, emails, calls, account activity and other information for the purpose of: - investigating alleged violations; - protecting employees and users; - maintaining security; - preventing fraud and abuse; - resolving disputes; - enforcing the Terms of Service; and - complying with applicable law.
Any collection, use and retention of personal information shall be handled in accordance with DealConverter's applicable privacy policy and applicable law.
Where DealConverter terminates an account because of the Customer's material violation of these Terms of Service, including serious or repeated abusive, threatening, harassing or materially disruptive conduct, the Customer will generally not be entitled to a refund for fees already paid for the affected subscription period, to the maximum extent permitted by applicable law.
This provision does not affect any refund or other remedy that DealConverter is legally required to provide.
Where termination occurs for reasons unrelated to Customer misconduct, the applicable provisions of DealConverter's Refund and Cancellation Policy shall apply.
Nothing in this section prevents a Customer from exercising any right available under applicable law.
The Customer may raise legitimate complaints, seek legal remedies, approach appropriate consumer or regulatory authorities, or exercise other lawful rights.
However, the exercise of a legal right does not authorize threats, harassment, violence, abuse or other unlawful conduct toward DealConverter personnel.
DealConverter will exercise its rights under this section reasonably and in good faith, taking into account the nature, seriousness, frequency and circumstances of the conduct.
Where appropriate, DealConverter may consider: - whether the conduct was isolated or repeated; - whether a warning was previously issued; - whether the Customer corrected the conduct; - whether employees or other customers were affected; - whether there was a security or safety concern; - whether the conduct was intentional; - whether the conduct materially disrupted Company operations; and - any other relevant circumstances.
Nothing in this section requires DealConverter to tolerate conduct that presents a genuine safety, security, legal or operational risk.
If any provision of this section is determined to be invalid, unlawful or unenforceable under applicable law, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in effect.
This Customer Conduct, Abusive Behaviour and Right to Suspend or Terminate section forms an integral part of the DealConverter Terms of Service.
By creating, accessing or continuing to use a DealConverter account, the Customer agrees to comply with these requirements.
